We must raise concerns with the Josephine Board of County Commissioner (BCC) on issues that have occurred
within the Josephine County Sheriff Office since Sheriff Dave Daniel was sworn into office on 05 JAN 2015.
It is our understanding;
• Sheriff Daniel is the "Chief Law Enforcement Officer" (CLEO) in Josephine County as
defined by the US Supreme Court.
o All sworn JoCo Sheriff Deputies law enforcement authority
was nullified and surrendered when CLEO authority transferred to Sheriff Daniel.
o Sheriff Daniel (CLEO) has not sworn in or deputized current
patrol deputies to enforce law.
o All law enforcement activities conducted by patrol deputies
prior to them being sworn in has established liability for JoCo and tax payers.
• The BCC approved taxpayer funds specifically to cover sheriff patrols 12 hours a day,
7 days a week.
o Sheriff Daniel has reduced patrols to 10 hours a day.
o JoCo taxpayers have now endured a 14 hour a week decrease
in patrols.
o JoCo sheriff deputies have now been given a bonus of 4 hours
pay, per pay period, for hours they are not working.
o This is a negative impact to the citizens of Josephine County
and in violation of the funds transfer agreement by BCC.
• Sheriff Daniel is establishing an "On-Call" deputy for after hours call out.
o He is authorizing the take home of patrol cars for this position,
to include deputies that live in Jackson County.
o County owned vehicles are maintained on a cost per mile basis.
No money is budgeted for this.
o The On-Call deputy will incur un-budgeted comp and overtime
that is unfunded.
o This is in direct violation of BCC vehicle use policy.
• Sheriff Officer Volunteers have not been scheduled to be re-issued ID cards.
o This put volunteers at risk for coverage on injury sustained
during a volunteer event.
o It has been stated this is a cost "saving" measure, in violation
of county policy.
o This affects SAR, JCEC, Dive Team, Posse and Reserve.
o Potential collapse of critical volunteer programs now exists.
o Incurred liability to the County.
o Put's volunteers at risk for incurred liability.
• No one is qualified or certified to stand up the Emergency Operations Center (EOC) in
an Emergency.
o If the county encounters an emergency or missing person,
EOC activation is impeded without a qualified person.
o Not having a qualified person negates reimbursement
opportunities from State and Federal government.
• Other current actions taking place that raises concerns;
o Proposing to replace current Deputy Uniforms at a cost of
approximately $850.00 per individual.
o Reducing jail cap from 130 inmates to 90 inmates, putting
JoCo citizens at risk.
o In-process all arrested for detainment, then release them,
increasing substantial workload for jail staff and creating false statics.
o Promotions / demotions occurring outside of contractual
agreement or BCC approval.
o Promoting a "Scientific Poll" that was conducted by a paid
consulting group of 404 JoCo residence out of 83,000.
We fully understand a newly elected representative has the authority to organize their department as they see fit
to do so. It appears substantial personal changes have occurred without cost benefit to the citizens of the county.
This must be done ethically and within established policy / agreements / guidelines / ordinance and ORS. The
current events appear to have potentially impacted the citizens of Josephine County negatively with lost patrol and
unfunded money being spent outside of line item budget. It is our understanding overtime is already 128% over
budget. We understand Sheriff Daniel will have an adjustment period to his new position, but it must be done
without costly mistakes and BCC oversight.
